Government to Scrap Immediate Wrongful Termination Plan from Employee Protections Act

The government has decided to remove its central measure from the workers’ rights act, swapping the right to protection from wrongful termination from the commencement of work with a six-month threshold.

Corporate Apprehensions Prompt Reversal

The step is a result of the industry minister told companies at a major conference that he would heed concerns about the impact of the legislative amendment on employment. A labor union insider commented: “They’ve capitulated and there might be additional changes ahead.”

Negotiated Settlement Reached

The national union body said it was prepared to accept the negotiated settlement, after days of discussions. “The absolute priority now is to get these rights – like first-day illness compensation – on the legal record so that staff can start gaining from them from next April,” its general secretary declared.

A union source noted that there was a view that the half-year qualifying period was more workable than the vaguely outlined nine-month probation period, which will now be abolished.

Political Backlash

However, parliamentarians are expected to be alarmed by what is a clear violation of the ruling party’s election pledge, which had promised “day one” safeguards against unfair dismissal.

The recently appointed business secretary has replaced the previous office holder, who had guided the bill with the deputy prime minister.

On Monday, the minister pledged to ensuring businesses would not “lose” as a result of the changes, which included a prohibition on flexible work agreements and immediate safeguards for employees against unfair dismissal.

“I will not allow it to become one-sided, [you] give one to the other, the other suffers … This has to be implemented properly,” he remarked.

Parliamentary Advance

A union source explained that the changes had been approved to permit the bill to move more quickly through the second house, which had greatly slowed the act. It will lead to the qualifying period for wrongful termination being lowered from two years to half a year.

The act had initially committed that duration would be removed altogether and the government had proposed a less stringent evaluation term that companies could use instead, limited in law to 270 days. That will now be eliminated and the statute will make it unfeasible for an worker to claim wrongful termination if they have been in post for less than six months.

Union Concessions

Worker groups insisted they had won concessions, including on expenses, but the move is expected to upset progressive lawmakers who regarded the employment rights bill as one of their key offerings.

The bill has been altered multiple times by other party peers in the Lords to meet major corporate requests. The minister had said he would do “whatever is necessary” to unblock procedural obstacles to the legislation because of the second chamber modifications, before then discussing its enforcement.

“The voice of business, the opinions of workers who work in business, will be considered when we get down into the weeds of enforcing those crucial components of the employment rights bill. And yes, I’m talking about non-guaranteed work agreements and immediate protections,” he stated.

Critic Reaction

The critic called it “another humiliating U-turn”.

“The administration talk about stability, but manage unpredictably. No business can strategize, allocate resources or hire with this amount of instability hanging over them.”

She said the legislation still contained provisions that would “damage businesses and be terrible for prosperity, and the opposition will oppose every single one. If the government won’t scrap the most damaging parts of this flawed legislation, we will. The nation cannot foster growth with more and more bureaucracy.”

Government Statement

The responsible agency stated the result was the result of a compromise process. “The government was happy to enable these negotiations and to showcase the advantages of cooperating, and remains committed to continue engaging with trade unions, business and companies to improve employment conditions, help firms and, importantly, realize prosperity and decent work generation,” it said in a statement.
